Terms of service.

1. Service Description:

InstructED offers personalised online tutoring services in a range of different subjects. Our services are tailored for students in Years 5-12. Tutoring sessions will be conducted through Google Meet and scheduled depending on the preference and availability of the student and tutor.

2. Pricing and Payment:

The fees for our tutoring services are outlined on the Services page of this website. Clients are required to pay for the full tutoring term in advance. This is calculated based on the number of weeks in the school term and is invoiced prior to tuition commencing. If the term cannot be completed for any reason refunds are at the discretion of InstructED and on a case by case basis.

If a client cannot attend a scheduled lesson, we make every effort to reschedule. However, if rescheduling is not possible, no refund is offered. If a tutor must cancel a lesson, every effort is made to reschedule, however if the client is unable to make rescheduled opportunities they forfeit the cost of that week.

3. Scheduling and Availability:

Tutoring sessions are scheduled based on the preferences and availability of clients and tutors. Clients must reschedule or cancel a session by emailing the tutor directly at least 12 hours before their scheduled online session.

4. User Responsibilities and Conduct:

Students are expected to maintain a respectful and conducive learning environment during sessions. Prohibited activities include abusive language, sharing inappropriate content, plagiarism etc.

5. Privacy and Data Protection:

We collect and use personal and academic information solely for the purpose of providing effective tutoring services. To enhance data security, we engage reputable third parties like Google for data processing.

While we trust these platforms for their robust security measures, InstructED does not assume responsibility for any data breaches or security incidents that may occur with these third-party services. We encourage our clients to review the privacy policies of these platforms to understand how their data is managed and protected.

Confidentiality of student information is a top priority. Please read our Privacy policy for more information on how InstructED endeavours to protect client data.

From time to time, InstructED may seek to showcase select student work as exemplars or for marketing purposes. Please be assured that the confidentiality and privacy of our students are of paramount importance. Accordingly, any student work shared for these purposes will be strictly anonymised to remove any identifiable information. Furthermore, InstructED will only use student work after obtaining explicit, written consent from the original client or student. This consent will detail the specific work to be used and the context in which it will be presented, ensuring transparency and respect for our client's and student's intellectual property.

6. Intellectual Property Rights:

Materials provided during tutoring sessions remain the intellectual property of InstructED and/or contracted tutors. Students are not permitted to record sessions or use materials provided for purposes outside of personal study without prior consent. Copyrights for any third-party materials used are respected and adhered to as per the applicable laws.

7. Limitation of Liability

Our services are provided ‘as is’ without any warranties, either express or implied. We do not guarantee specific academic results or improvements. We shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use of or inability to use our services. The above limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

In the event of a dispute arising from or in connection with these Terms or our services, we strongly encourage you to contact us directly to seek a resolution.

9. Changes to Terms of Service

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.

11. Termination of Services

a. Termination by InstructED: InstructED reserves the right to terminate the service agreement at any time upon providing written notice to the client. Reasons for termination may include, but are not limited to, failure to comply with these Terms, failure to make payment, or breach of the user Code of Conduct.

b. Refund Policy on Termination: Clients are required to pay for the tutoring term in advance. In the event of termination by the client before the end of the agreed term, no refund will be provided unless there is substantial evidence that the tutor has breached the user code of conduct. In such cases, a proportionate refund for the unused portion of the term may be considered at InstructED's discretion.
